Clear arrangements for both partners
A marriage contract sets out what applies in the event of separation or divorce – for example regarding assets, maintenance or pension rights. It can be concluded before the wedding, during the marriage or in the course of a separation.
A marriage contract must be notarised with both partners present at the same time (section 1410 BGB). The notary advises both sides impartially and ensures a fair arrangement.

How your marriage contract is made

Initial meeting
Both partners describe their situation and goals – together or one after the other.

Draft
You receive a draft and have time to review it and, if you wish, have it reviewed by a lawyer.

Notarisation
Both partners are present at the same time. The notary reads the contract aloud and explains it.

Completion
You receive certified copies. If necessary, we arrange any further steps.

What does the notary cost?
Notary fees are set by law for all notaries in Germany (Court and Notary Fees Act, GNotKG). They depend on the value and type of the transaction – not on the time spent.

When does a marriage contract make sense?

Do both partners have to attend the appointment?
Yes. For a marriage contract the law requires both partners to be present at the same time.
What is a divorce settlement agreement?
A contract in which spouses settle the consequences of a separation – such as the division of assets, maintenance and pension rights adjustment. It can make court proceedings considerably simpler.
Does the notary represent one of the partners?
